Passing on of data

Within cloudKleyer GmbH, access to your data is granted to those offices that require it for the fulfilment of contractual and legal obligations or for internal administrative purposes. Your personal data will not be passed on to bodies outside cloudKleyer GmbH unless this is necessary for the purpose of processing the contract, you have given your express consent, we can claim a legitimate interest or we are required to do so by the authorities or a court of law.

These include companies in the business areas of IT services, logistics, printing services, telecommunications, debt collection, management consultancy and sales and marketing. Insofar as we commission external service providers as processors, they are carefully selected and obliged to comply with all data protection regulations in accordance with Article 28 of the Data Protection Regulation.

These cookies enable us to recognise your browser on your next visit. Your browser can be configured in such a way that, on the one hand, you are informed about the setting of cookies and only allow them in individual cases and, on the other hand, the acceptance of cookies is excluded. In this context, please refer to the respective manufacturer’s information of your browser. If cookies are deactivated, the functionality of this website may be limited.

We maintain so-called “fan pages” and company-related online presences on various social networks and platforms in order to communicate with customers and interested parties there and to be able to inform them about our services and activities. For this purpose, we provide links to our fan pages and online presences on our website so that they can be found more quickly. Data security

Our employees and the service companies commissioned by us are obliged to maintain confidentiality and to comply with the provisions of the applicable data protection laws. The company takes appropriate technical and organizational security measures to protect your personal data against loss, alteration, destruction and against access by unauthorized persons or against unauthorized disclosure. Our security measures are constantly being improved in line with technological developments.

Duration of data storage

We generally store your data for the duration of the contractual relationship existing with you or with your employer or for as long as it is required to provide our online services. Beyond that, we store your personal data insofar as we have a legitimate interest in further storage. The deletion of the data takes place after the expiry of the legal or contractual retention periods, for example with regard to tax and commercial retention periods. Data that is not subject to the retention obligation will be deleted once the aforementioned purpose ceases to apply.

Rights as a customer, supplier and user of our website

As a customer or user of our website, you have various rights. Please use the information in the Contact section to assert your rights. In doing so, please ensure that we are able to clearly identify you. In accordance with the General Data Protection Regulation, you can obtain information about what data is stored about you at any time upon request and free of charge in accordance with Art. 15 DS-GVO. Please note that your right to information may be restricted under certain circumstances in accordance with the statutory provisions, in particular in accordance with Section 34 BDSG-neu.

Furthermore, according to Art. 16 DS-GVO you have the right to correction or according to Art. 17 DS-GVO to deletion of this data, as far as the legal requirements are met. Excluded from the right to deletion is, for example, stored data on business processes that are subject to statutory retention obligations.

Furthermore, according to Art. 18 DS-GVO, you may have the right to have the processing of your personal data restricted.

Right of objection

In addition, according to Art. 21 DS-GVO, you have the right to object at any time to data processing that we carry out to protect legitimate interests for reasons that arise from your particular situation. We will then stop processing your data unless we can demonstrate – in accordance with the legal requirements – compelling legitimate grounds for further processing that outweigh your interests.

Right to object to direct marketing

You may also object at any time to the processing of your personal data for advertising purposes (advertising objection). Please take into account that, for organizational reasons, there may be an overlap between your revocation and the use of your data in the context of an already ongoing advertising campaign.

Right to data portability

Furthermore, upon request, we guarantee transferability of the personal data you have provided by means of provision in a common and machine-readable data format.

Obligation to provide personal data

Insofar as a contractual relationship exists between cloudKleyer on the one hand and you on the other hand, you must provide those personal data that are required for the commencement, implementation and termination of the contractual relationship and for the fulfillment of the associated contractual obligations or which we are legally obliged to collect. Without the provision of this data, we will generally not be able to execute a contract with you.
As far as the data processing in the context of the use of this website is not necessary for the initiation, implementation and termination of a contractual relationship or for the fulfillment of contractual obligations and is also not required by law, the provision of your data is voluntary. Please note that certain functionalities of the website or other services cannot be used if the required data is not provided.

Automated processing of personal data

Exclusively automated processing of your personal data will only be carried out if it is necessary for the conclusion or fulfillment of a contract and if it does not have any legal or similar effect on you.

Complaints to supervisory authorities

In the event of complaints regarding the processing of your personal data, you have the right to contact the competent supervisory authorities. For this purpose, you can contact the competent data protection authority. This is for ArchiGas: The Hessian Commissioner for Data Protection and Freedom of Information.
